These Terms of Use ("Terms") are a legal agreement between you and Kameron Meeker ("Goal Grower," "we," "us," or "our") governing your access to and use of the Goal Grower mobile application and this website (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the higher minimum age required in your country, such as 16 in some parts of the EEA/UK) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms.
2. Your account
You can create an account with an email and password, or by using Sign in with Google or Sign in with Apple. You agree to provide accurate information, to keep your credentials secure, and that you are responsible for all activity under your account. Notify us at kameron@expymed.com if you suspect unauthorized use. You may delete your account at any time from the app's Settings screen or by contacting us.
3. License to use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Goal Grower for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Service, reverse engineer or attempt to extract its source code, or use it except as permitted by these Terms and the Apple App Store terms.
4. User content and social conduct
You retain ownership of the goals, garden, and other content you create ("Your Content"). You grant us a worldwide, non-exclusive license to host, store, reproduce, and display Your Content solely to operate and provide the Service — including displaying it to other users you choose to connect or share with (for example, friends, followers, or members of a shared garden).
You agree not to use the Service to:
- Break the law or infringe others' rights
- Harass, bully, threaten, or harm other users
- Post content that is hateful, obscene, deceptive, or otherwise objectionable
- Impersonate others or misrepresent your affiliation
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems
- Use bots, scrapers, or other automated means without our permission
We may remove content or suspend accounts that violate these Terms. To report abuse, contact kameron@expymed.com.
5. Virtual items and in-app currency
The Service may include virtual items and in-app currency ("coins") and other digital goods. These have no monetary value, are not real money or property, and cannot be redeemed, transferred, or exchanged for cash or anything of value outside the Service. Coins and virtual items are licensed to you, not sold, for personal use within the app. Except where required by law, purchases of virtual items are final and non-refundable, and we may change, limit, or discontinue virtual items at any time.
6. Goal Grower PRO and purchases
Goal Grower offers optional in-app purchases, including a paid subscription ("PRO") with additional features. Pricing and purchase details are shown in the app at the time of purchase.
- Billing: payment is charged to your Apple ID at confirmation of purchase.
- Auto-renewal: subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, and your Apple ID is charged for renewal within 24 hours before the period ends.
- Managing and canceling: you can manage or cancel a subscription in your Apple ID Account Settings.
- Refunds: purchases and refunds are handled by Apple under Apple's policies. We do not process payments or refunds directly.
7. Beta / TestFlight
The Service may be offered as a beta (for example, through Apple TestFlight). Beta versions are provided for testing, may be incomplete or unstable, may change or be discontinued, and are provided "as is." Please share feedback so we can improve.
8. Not medical or professional advice
Goal Grower is a habit and goal-tracking tool for general wellbeing and motivation. It is not medical, mental-health, or professional advice, and does not guarantee any particular outcome. Always seek qualified professional help for health or medical concerns.
9. Intellectual property
The Service, including its design, graphics, artwork, plants, code, and content (other than Your Content), is owned by Kameron Meeker and protected by intellectual property laws. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA WILL ALWAYS BE PRESERVED.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Kameron Meeker WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold harmless Kameron Meeker from any claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service or its users. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.
14. Governing law
These Terms are governed by the laws of the State of Idaho, United States, without regard to its conflict-of-law rules. You agree that the state and federal courts located in Idaho will have exclusive jurisdiction over any dispute not otherwise resolved, except where applicable law gives you the right to bring a claim in your local courts. Before filing any claim, please contact us so we can try to resolve it informally.
15. Apple App Store terms
These Terms are between you and Kameron Meeker only, not Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the Service, and Apple is not responsible for addressing any claims relating to the Service, including product-liability, legal or regulatory, and consumer-protection claims, or any third-party claim that the Service infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
